(“Atomiq,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects Personal Information (as defined herein), and the steps we take to safeguard it when individuals (“you,” “user,” and “your”) visit our website at https://tryatomiq.com (the “Website”), use the Atomiq platform (the “Platform” and, collectively with the Website, the “Services”), and/or otherwise interact or communicate with us.

This Policy applies to all users of the Services, including users in Canada, the European Economic Area (EEA), the United Kingdom (UK), the United States, and all other jurisdictions in which the Services are available.

This Policy should be read together with our Platform Terms of Service. By visiting our Website, using the Platform, and/or otherwise interacting or communicating with us, you agree to the collection and use practices described in this Policy.

By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with our data practices as described herein, please do not use the Services.

COLLECTION OF PERSONAL INFORMATION

“Personal Information” as used herein means information which relates to an individual and directly or indirectly allows that individual to be identified.

We collect Personal Information directly from you when you visit our Website, use our Platform, and/or otherwise interact or communicate with us. In some instances, our third-party service providers may collect your Personal Information on our behalf.

The Personal Information we collect depends on how you interact with us. It may include information such as:

  • Contact information, including your name and email address for account activation purposes;
  • Account registration information and credentials such as usernames, passwords, password hints, and similar security information used for authentication;
  • When you subscribe to a paid plan, payment card or payment method details (processed through our third-party payment processor) and your billing address;
  • Cookie and tracking information, such as an Internet Protocol (IP) address, device identifier, location data, browser type and language, access times, the Uniform Resource Locator (URL), other unique identifiers, internet or network activity (usage and log data), and other technical data that may uniquely identify your device, system or browser; and
  • Other Personal Information as may be required from time to time, with your consent.

We limit the Personal Information we collect to that which is required to achieve the Purposes described below and only for as long as necessary to fulfill the Purposes or as required by law.

USE OF PERSONAL INFORMATION

We use Personal Information for the following purposes (collectively, “Purposes”):

  • Providing our Service, including providing the agentic spreadsheet to help you provide a broad range of spreadsheet-based work.
  • Fulfilling our business purposes, including operating our Website; developing and maintaining business relationships; responding to inquiries and complaints; following-up after customer service and sales interactions; collecting opinions and comments; generating business insights; providing demonstrations; security monitoring; and general business operations and administration.
  • Marketing and advertising purposes, including communicating with customers about new services or promotions and identifying patterns of behaviour to offer suggestions and provide a personalized online experience.
  • For detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • For internal research for technological development and demonstration.
  • Exercising our legal rights and complying with applicable laws and regulatory requirements.
  • As otherwise described at the time of collection.
  • For other purposes, for which we will obtain consent from time to time.

We may also use Personal Information to generate de-identified and anonymized data and to prepare aggregated statistics. We may use de-identified and anonymized data for business purposes, such as research and development, to monitor and improve the Services, marketing, customer service, and business analytics.

When you use the Platform, you may also upload, create, or input data including spreadsheets, files, and prompts (“Customer Content”). Customer Content may contain Personal Information about you or other individuals. We process Customer Content solely at your direction and on your behalf to provide the Services.

You, as the customer, remain the controller of such data and are responsible for:

  • Ensuring you have a lawful basis to process any Personal Information you input into the Platform;
  • Providing appropriate privacy notices to individuals whose data you include in Customer Content;
  • Responding to data subject requests relating to Personal Information in your Customer Content (we will assist you as required by applicable law); and
  • Complying with all applicable data protection laws in relation to your processing activities.

TRANSFER OR DISCLOSURE OF PERSONAL INFORMATION

We do not sell or trade any Personal Information. We may transfer your Personal Information to our third-party service providers, who provide services on our behalf. Specifically, we may engage third party service providers to provide the following services on our behalf:

  • user registration;
  • payment and transaction processing and storage;
  • marketing, including email communications;
  • AI model processing, secure login, data hosting and cloud storage; and
  • communication services.

In sharing Personal Information with our third-party service providers, we take reasonable contractual and other measures to protect the Personal Information. These third parties are prohibited from using your Personal Information for their own purposes.

While we are based in Canada, some of our third-party service providers may be located in jurisdictions outside of Canada, such as in the United States. When your Personal Information is collected or used in another country, it is subject to the laws of that country and may be accessible to the governments, national security, courts or law enforcement or regulatory agencies in that jurisdiction.

We and our third-party service providers may disclose your Personal Information as permitted or required by law. For example, we and our third-party service providers may disclose your Personal Information to law enforcement, government bodies or other organizations in response to a warrant, subpoena, or other court order. Such disclosures may also be made for the purpose of investigating a breach of an agreement or contravention of law, for detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable law.

We may also disclose Personal Information to another organization in the event:

  • We buy, sell, or otherwise acquire or dispose of our organization or a part of our organization, or any of its assets;
  • We merge or amalgamate our organization with another;
  • We make or receive a loan or other financing;
  • An organization creates a charge on, or the take of a security interest in or a security on, any assets or securities of our organization; or
  • We lease or license any of our organization’s assets.

Any such disclosures will be conducted in accordance with applicable law. We may also disclose your Personal Information for other purposes, with your consent.

ARTIFICIAL INTELLIGENCE

The Platform uses artificial intelligence models provided by third parties to deliver its core functionality. Our current AI model providers include OpenAI, Anthropic and Google. Open-weight models are accessed through intermediary services (such as OpenRouter). We may change, add, or remove AI model providers at any time. The specific model used may vary depending on the task being performed.

The Platform generates outputs in response to your prompts and inputs, and performs automated agent actions on your behalf. We collect and process these outputs and action logs as part of delivering the Services.

When you use AI-powered features, the following data may be transmitted to third-party model providers for processing:

  • Your prompts and inputs;
  • Relevant portions of your Customer Content necessary to generate the requested output; and
  • Contextual information needed to perform agent actions.

We transmit only the data necessary to fulfill your request. AI model providers process this data solely to return a response and do not retain it beyond the processing session except as required for safety monitoring and abuse prevention.

Training and Model Improvement

Paid-tier accounts: We do not use data from paid-tier accounts to train or fine-tune any AI models (whether our own or those of third-party providers). Your Customer Content on a paid plan is used solely to deliver the Services to you.

Free-tier accounts: We reserve the right to use anonymized and aggregated data from free-tier accounts for the purpose of improving our services, which may include training or fine-tuning AI models in the future. Such data will be de-identified prior to any such use. We will update this Policy before any such training program begins.

Third-party providers: Our agreements with third-party AI model providers prohibit them from using Customer Content to train, improve, or fine-tune their models.

AI Output Disclaimers

AI-generated outputs may contain errors or inaccuracies. Atomiq does not guarantee the accuracy, completeness, or fitness for purpose of any AI output. You are solely responsible for reviewing and validating AI-generated outputs before relying on them. For further information, see our Platform Terms of Service.

RETENTION AND PROTECTION OF PERSONAL INFORMATION

We will only retain Personal Information for as long as is necessary to fulfill the Purposes for which the information was collected, to resolve disputes or enforce our agreements, to protect against abuse or fraud, or as may be permitted or required by applicable law. After that time, the Personal Information will be destroyed in accordance with our retention policies.

If you delete or terminate your user account, we will deactivate it, but we may retain your Personal Information for a certain period of time for business, legal and contractual reasons and disclose it in a manner consistent with our practices under this Policy.

We are committed to safeguarding your Personal Information against loss or theft, unauthorized access, disclosure, copying, use or modification. We protect Personal Information with appropriate administrative, technical, and physical security measures. Only employees and third-party service providers with a need to know Personal Information will have access to this data. All such employees and third-party service providers have agreed to maintain the confidentiality of this information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Service. Any transmission of Personal Information is at your own risk.

SERVICE PROVIDERS AND THIRD PARTY WEBSITES

We engage third-party companies and individuals to perform services on our behalf. These parties have access to your Personal information only to perform specific tasks and are contractually obligated not to disclose or use it for any other purpose. Our key sub-processors include:

  • Cloud hosting: Amazon Web Services (AWS) for data hosting and infrastructure (United States)
  • AI model providers: OpenAI, Anthropic, Google, and other providers for AI processing (United States)
  • Payment processor: Stripe for payment and billing processing

Our Website may also include links to third-party websites, as well as content and applications hosted and served by third parties. When clicking on those links, these third-parties may collect your Personal Information. If you follow a link to a third-party website, we encourage you to read the third party’s privacy policy for information on its privacy practices.

INDIVIDUAL RIGHTS

Where granted by applicable law, you may request disclosure of the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share it. You may also have the right to request access to, and a copy of, the Personal Information that we have collected about you, and you may also have the right to request that any inaccuracies in that information be corrected, or that the Personal Information we have about you be deleted.

You also have the right to withdraw your consent for the collection, use and disclosure of your Personal Information at any time, subject to legal and contractual obligations and reasonable notice. If you request to “opt-out” or withdraw your consent for the collection, use and/or disclosure of your Personal Information, we may inform you of the consequences of doing so before processing your request.

There are simple procedures in most browsers that allow you to delete existing cookies, to automatically decline cookies or to be given the choice of declining or accepting cookies.
